Release

I hereby represent and warrant that I have the right and authority to submit the attached photographs, text and information to AETN All Asia Networks Pte Ltd, with offices at 11C Mount Sophia #03-16 Old School, Singapore 228467 (“THC Affiliate”), and hereby irrevocably grant to THC Affiliate and A&E Television Networks, with offices at 235 East 45th Street, New York, NY 10017, USA (“AETN”), and their respective successors, licensees and assigns the right in perpetuity to use, re-use, publish, and re-publish, and otherwise reproduce, modify and display, the photographs (“Photographs”), any text and information that is submitted (“Text”), and my name and likeness and the name and likeness of the persons depicted in the submitted photographs (“Name/Likeness”), in whole or in part, in connection with the project currently titled “Photos for the Future” (“Project”) in any advertising, publicity, and promotion, or for any purpose whatsoever, in any manner at any time or place, in any present or future media, throughout the world in perpetuity relating to the Project. I agree that the Photographs, Text and Name/ Likeness may be combined or used in conjunction with other images, text and graphics, and cropped, altered or modified.

I represent and warrant that I have the right and authority to grant to THC Affiliate and AETN and their respective successors, licensees and assigns the rights granted in this agreement on behalf of the photographer and/or the persons depicted in the Photographs. I represent and warrant that I have the right and authority to grant to THC Affiliate and AETN and their respective successors, licensees and assigns the rights granted in this agreement on behalf of the author of the Text. I represent and warrant that the Photographs and/or Text do not infringe any intellectual property rights (including but not limited to copyrights) or other rights of any third parties. The rights granted in this agreement specifically include, but are not limited to, the right to use the Photos, Text and Name/Likeness on the Internet, on all forms of television, in video cassettes and discs, in all other video device forms and configurations, in printed materials, and in any and all interactive devices or technologies existing now or developed in the future. I am at least eighteen (18) years of age and I have the right to enter into this agreement and to grant all of the rights that are being granted in this agreement, or if I am below eighteen (18) years of age, my parent or guardian has given his/her consent for me to enter this agreement and shall [click on] [sign] this agreement on my behalf.

I hereby release THC Affiliate and AETN and their respective successors, licensees and assigns from any and all claims that I may at any time have in connection with their use of the Photos, Text or Name/Likeness, including without limitation, any and all claims for libel and/or invasion of privacy, infringement of any intellectual property or other rights, and agree to indemnify and hold harmless THC Affiliate and AETN, and their respective successors, licensees, assigns, sponsors, advertising agencies and distributors against all claims, damages, liabilities, costs and expenses including, but not limited to, reasonable counsel fees, arising out of the use of the Photos, Text or Name/Likeness. I also waive all moral rights in relation to the Photographs, Text and Name/ Likeness or THC Affiliate and/or AETN’s use of the Photographs, Text and Name/ Likeness.

THC Affiliate and AETN may sell, assign, license or otherwise transfer all rights granted to them hereunder.

This agreement shall be governed by the laws of Singapore. I agree that I am fully responsible for ensuring that my entering into this agreement is lawful in accordance with the laws of the country of which I am a citizen and/or resident of, and/or happens to be at the time that this agreement is entered into. Neither THC Affiliate nor AETN shall be taken to make any representations, express or implied, as to the lawfulness of this agreement.

Nothing in this agreement shall require THC Affiliate, AETN or any of their respective successors, licensees and assigns to use any of the Photographs, Text or Name/Likeness.
